When E-Scooters Crash, Who is Liable?

In 2018, many companies, including Lime, Bird and Spin, began to roll out motorized scooter rentals throughout the U.S. Currently, it is believed that 8 people have died from e-scooter related accidents and over 1,500 have been injured. Before you decide to rent a scooter, you should understand the insurance implications and know whether you are covered under any insurance policy, in the event of an accident.

So, are you covered if you run into and injure a pedestrian while on an e-scooter? What if you are injured when a car hits you? Who covers your medical bills?

The scooter driver will likely be held liable for mistakes made and injuries cause while operating the scooter. How You Can Recover Your Full Deductible

You’ve just been in a crash and the other party (the third party) doesn’t have insurance or denies liability. As a result, you make a claim under your own automobile insurance for your property damage. The problem is, you have to pay a deductible, often $500. Can you ever recover that when the third party has insurance? Our Supreme Court has given an answer.

In Daniels v. State Farm Mutual Automobile Insurance Co., Wash., No. 96185-9, 2019 WL 2909308 (July 3, 2019), the Washington Supreme Court recently held that an insured (you) must receive the full deductible before the insurer may distribute any recovered funds to itself.

Daniels was the middle car in a three-vehicle crash. The at-fault driver denied liability and Daniels used her own property damage insurance with State Farm and paid her $500 deductible. State Farm then recovered 70% of the repair costs from the at-fault driver and reimbursed Daniels 70% of the $500 deductible – or $350. Daniels sued State Farm, arguing that State Farm could retain money recovered directly from an at-fault party only after the insured, Daniels, was fully reimbursed for her loss, the $500 deductible. The Court agreed.

State Farm argued that the “made whole” doctrine did not apply to a subrogated insurer’s direct action against an at-fault party. Averill v. Farmers Ins. Co. of Washington, 155 Wn.App. 106, 229 P.3d 830 (2010). The “made whole” doctrine requires that an injured party must be placed in the same position as he or she was prior to the crash before the insurer may require the injured party to reimburse the insurer. State Farm also relied on WAC 284-30-393, which requires subrogated insurers to reimburse deductibles “less applicable fault.” The Washington Supreme Court held that the “made whole” doctrine did apply to any and all loss recovery, no matter the manner of recovery.

A previous case, Averill, allowed the insurer to allocate recovery to itself, before the insured, contending that it was consistent with the purpose of the deductible. However, Daniels rejected this reasoning noting that the deductible had other purposes, including that the deductible shifts coverage of smaller losses to the insured, which saves on administrative expenses, and enforcement of the “made whole” doctrine in subrogation situations does not interfere with this purpose. The Daniels Court also noted that it had not previously distinguished between reimbursement to insurers from recovered funds based on recovery from suing the third-party or recovery from their insured.

The Daniels Court also held that WAC 284-30-393 did not support State Farm here. Instead, this regulation allows for a deduction of the reimbursement to the insured for “applicable comparable fault.” However, there was no finding of fault on the part of Daniels. Therefore State Farm could not reduce the amount they reimbursed her for her deductible. The upshot for insured drivers after Daniels is that, regardless of how recovery is made, a fault-free insured must recover their entire loss before the insurer may reimburse itself.

According to a June 2017 article in Patch , Seattle police are looking for a semi-truck driver involved in an accident that injured a driver.

The accident happened early on a Thursday morning along I-5 and near Seneca Street. A 60-year-old man was driving a minivan and clipped the rear of the semi-truck as he tried to change lanes. As a result, the car flipped onto its hood.

Police say the driver of the semi continued driving after the minivan flipped onto its hood. Police consider the car accident a “hit and run” because the semi-driver did not stop after the accident. The minivan driver was taken to the hospital where he was treated for his injuries. One of the injuries the minivan driver suffered was a broken arm.

According to a KOMO , in March 2017, two teenage boys were injured in a car wreck. The wreck left the car the boys were in wrapped around a tree in South Seattle.

Legal Duty in a Seattle Car Accident

In March 2017, a two-vehicle crash sent one of the vehicles into a gas pump and triggered a fire, according to Q13FOX .

The accident happened in North Seattle at a Shell station on Holman Road NW. The two cars slammed into each other shortly before 8 p.m. One of the vehicles involved in the crash traveled about 35 feet and slammed into a gas pump and caused a fire.

Firefighters were able to quickly extinguish the fire after they arrived on the scene.

According to investigators, a 60-year-old rideshare driver operating a Nissan allegedly hit a Honda traveling north on Holman Rd. The rideshare driver had a passenger in his vehicle at the time of the crash.

The impact sent the Honda sideways and into a tree. The Honda was split into two as the result of the impact. The driver was rushed to Harborview Medical Hospital. They had life-threatening injuries.

The passenger in the ride sharing vehicle was taken to the same hospital for non-threatening injuries. The rideshare driver was not injured.

The report did not include information on whether police would cite the rideshare driver or file criminal charges for allegedly hitting the Honda. The outcome of the driver and passengers are not known either. Both parties injured in the March accident may have the right to sue for damages related to their injuries.

A 72-year-old woman died in early May, 2017 after a vehicle crashed into an assisted living home, according to Patch.com .

The accident happened around 11 a.m. about a week prior to the woman’s death. The location of the home was in the Meadowbrook neighborhood, just south of Lake City. She died of blunt force trauma to her chest with compressive asphyxia. The coroner ruled her death accidental.

At least seven people were injured or killed in recent truck accidents around Puget Sound in May, 2017, according to Patch .

One accident involved a semi-trailer that overturned near 72 nd Street and I-5 near Tacoma. The semi-truck driver died at the scene. A total of four other vehicles were involved. Those drivers and passengers sustained minor injuries.

Another semi-truck accident near Olympia caused one individual to sustain minor injuries.

The third crash happened along SR 167 near Algona. A 33-year-old from Lake Tapps was killed when a semi-truck allegedly hit his car. The sudden motion pushed his vehicle into a car stopped in front of him.

According to Washington State Patrol, the semi-driver was allegedly traveling too fast while entering an off-ramp going to Ellingson Road. An occupant in another vehicle was taken to the hospital.

In a fourth accident involving a semi-truck, the driver was traveling along SR 507 near Roy when he allegedly lost control and slammed into a house.

It is not known if any of the victim of the truck accidents will sue. It is also not clear if anyone else was at fault for the truck accidents.

In late April 2017, a Renton man was critically injured in a Seattle motorcycle accident, according to Seattle Patch. The accident happened in South Seattle just prior to 7 p.m. that day. The 26-year-old man was allegedly hit by an impaired driver of an SUV.

According to Seattle police, the motorcyclist was traveling near the intersection of 56th Avenue South and South Bangor. It was a few blocks north of the Skyway area. The driver of the BMW SUV, an 80-year-old man, was traveling eastbound when he allegedly decided to make a U-turn. He was attempting to go westbound by making the U-turn. The 27-year-old motorcyclist was also headed east when the alleged U-turn was made. That is when the collision happened.

Seattle detectives were continuing to investigate the crash at the time the article was published. The driver of the SUV was released by police pending the results of a blood test. The motorcyclist aunt set up a GoFundMe page to help with his medical expenses. The outcome of any criminal investigation is not known at this time. It is also not know if the motorcyclist will file a lawsuit to recover damages sustained from the crash.
